3.4 ANTITRUST ENFORCEMENT AND INTERNATIONAL TRADE REGULATION
- The 1994 Guidelines say there always has been "a close relationship" between the
trade regulations and the enforcement of the antitrust laws of the United States in the
international context. As is clear from the case of imposition of the antidumping duties,
however, the provisions and enforcement of the U.S. trade regulations have given rise to
so many questions in the light of the principles of the U.S. antitrust laws. We consider
the U.S. antitrust authority and the U.S. trade authority should organize sufficient
coordinating efforts and come up with the uniformed interpretation of the both
regulations.
- Upon the conclusion of implementing agreements for GATT-Uruguay Round,
extensive amendments have been made to the determination of "unfair trade practice"
provided in Section 301 of the 1974 Trade Act, and some related issues to the
competition are to be added to the NTE Report. However, the judgment by the U.S.
trade authority in respect of "unfair trade practice" provided in Section 301 of the 1974
Trade Act is extremely one-sided and has been causing friction with other foreign
nations. The Justice Department should present its independent view on Article 301
of the Trade Law and proceed with coordination efforts with the Trade authority.
